Summary

On May 9, 2019, at approximately 6:40 p.m., [redacted] jumped over the turnstile without paying, at the Fordham Road 4 subway station in the Bronx. [redacted] was stopped by PO Railyng Frias and PO Elizabeth Munoz, of Transit Bureau District 11. While PO Frias wrote [redacted] a summons for fare evasion, [redacted] attempted to record the interaction with his cell phone. PO Frias told [redacted] to put his cell phone away (Allegation A: Abuse of Authority, [redacted]). After PO Frias issued the summons, he told [redacted] to leave the subway station several times, which [redacted] refused to do. PO Frias then pushed [redacted] through the turnstile and placed him under arrest (Allegation B: Force, [redacted]).
