On September 24, 2019, at approximately 11:00 a.m., [redacted] was inside of her apartment at [redacted] in Manhattan working when she heard her doorbell. [redacted] opened her door and saw, PO Emmett Butler and PO Terence Walsh, both of the 34th Precinct.
PO Butler and PO Walsh told [redacted] that someone called 911 and reported that [redacted] said she was going to kill herself and EMS needed to evaluate her. [redacted] tried to close her door, but PO Walsh held [redacted] s door open (Allegation A – Abuse of Authority: Entry of Premises: [redacted]).
[redacted] then went into her apartment and PO Butler fully opened [redacted] s door and entered her apartment (Allegation B – Abuse of Authority: Entry of Premises: [redacted]).
Two additional officers, PO Jose Jimenez and PO Roberto Garcia, also of the 34th Precinct, then arrived at [redacted] s apartment, but left the scene shortly after arriving.
[redacted] returned to her door and PO Butler and PO Walsh exited [redacted] s apartment and stood in the hallway with PO Butler standing in the doorway (also Allegation B). Lieutenant James Moore then arrived with his driver, PO Wilfredo Rodriguez. Lieutenant Moore instructed PO Rodriguez to wait outside of the apartment building.
EMT [redacted] and EMT [redacted] then arrived at [redacted] s apartment and evaluated [redacted]. [redacted] refused to show the EMTs her text message exchange and Lieutenant Moore told her that she was going to the hospital (Allegation C – Abuse of Authority: Forcible Removal to Hospital: [redacted]). [redacted] told the officers and EMTs to wait in the hallway while she went inside her apartment. Lieutenant Moore then entered [redacted] s apartment (Allegation D – Abuse of Authority: Entry of Premises: [redacted]). Lieutenant Moore walked down the hallway toward [redacted] s bedroom and encountered [redacted] standing at the door to [redacted] s bedroom.
