Summary

At approximately 4:00 p.m. on September 20, 2019, [redacted] was in the 19th Precinct stationhouse in Manhattan. [redacted] was in a holding cell due to an arrest earlier in the day. Sgt. James Gebhard and PO Donald Aridas of the 19th Precinct were in the vicinity of the holding cell. Sgt. Gebhard allegedly cursed at [redacted] (Allegation A: Discourtesy). [redacted] urinated on the cell floor. Sgt. Gebhard determined [redacted] needed to be removed to the hospital and entered the holding cell (Allegation B: Abuse of Authority). [redacted] was placed in handcuffs, removed from inside the cell, and sat on the bench outside of the holding cell. PO Aridas allegedly grabbed the front of [redacted]'s neck and restricted his breathing (Allegations C and D: Force). PO Aridas placed a facemask on [redacted] (Allegation E: Force). [redacted] was removed to the hospital. On September 21, 2019, [redacted] was discharged from the hospital and returned to the 19th Precinct stationhouse.
