At approximately 7:51 p.m. on October 11, 2019, Police Officer Elizabeth Drozd-Spidle and Police Officer Vincent Giaquinto of the 61st Precinct pulled [redacted] over in front of 2137 Knapp Street in Brooklyn and accused him of speeding and of creating unreasonable noise with his vehicle. When Police Officer Giaquinto asked [redacted] to produce his driver's license, vehicle registration and proof of insurance, [redacted] started looking around the interior of his vehicle for the documents. While doing so, he opened his center console, which contained two folding knives. Police Officer Giaquinto asked [redacted] to exit his vehicle. Once [redacted] got out, Police Officer Drozd-Spidle reached into the vehicle and removed the two knives (Allegation A: Abuse of Authority – Vehicle search, [redacted]) then reached towards his pockets to take out his phone. Police Officer Giaquinto drew and allegedly pointed his gun at [redacted] (Allegation B: Force – Gun pointed, [redacted]). He put his gun away when he saw that [redacted] was only reaching for his phone. [redacted] was ultimately unable to produce identification at the scene of the stop, so he was handcuffed and taken into custody. Officers also took custody of [redacted] s vehicle and transported it to the 61st Precinct stationhouse (Allegations D and E: Abuse of Authority – Seizure of property, [redacted]). There, Police Officer Drozd-Spidle and Police Officer Giaquinto conducted a full search of the vehicle (Allegations F and G: Abuse of Authority – Vehicle search, [redacted]).
