Summary

On November 8, 2019, at approximately 8:20 p.m., [redacted] was at [redacted] a restaurant located at [redacted] in Manhattan. One of the managers, [redacted] asked [redacted] to leave the premises because she had received complaints that [redacted] had been harassing customers for free drinks. [redacted] refused to leave, and [redacted] asked another manager, [redacted] to call 911. A few minutes later, PO Thomas Chille and PO Michael Miller, both of the 14th Precinct (PO Miller has since been transferred to Fleet Service), arrived at the location and, having confirmed with security and [redacted] that [redacted] was no longer permitted on the premises, asked [redacted] to leave. When [redacted] refused to leave, PO Chille and PO Miller took [redacted] by the arms, handcuffed her, and allegedly dragged her out to the sidewalk (Allegations A and B: Force – Physical Force, [redacted]).
Once PO Chille and PO Miller were on the sidewalk with [redacted] they determined that she needed to be evaluated at the hospital for intoxication and erratic behavior (Allegations C and D: Abuse of Authority – Forcible Removal to Hospital, [redacted]). While waiting for the ambulance to arrive, PO Miller told [redacted] that if she went back inside the restaurant she would probably get "locked up," (Allegation E: Abuse of Authority – Threat of Arrest, [redacted]) and that he would "put her on the ground" (Allegation F: Abuse of Authority – Threat of Force (Verbal or Physical), [redacted]). PO Miller pushed [redacted] back away from him approximately one foot (Allegation G: Force – Physical Force, [redacted]). The ambulance arrived approximately 20 minutes later, and after speaking with PO Chille and PO Miller, the EMTs took [redacted] to [redacted] for evaluation.
