On December 5, 2019, at approximately 1:00 p.m., [redacted] was at [redacted] in Queens. He and one of the employees engaged in a dispute that resulted in [redacted] sustaining a knee injury which required an ambulance. Police Officer Miguel Leon and Police Officer Caitlin Martin, both of the 102nd Precinct, arrived, as did an ambulance. While inside the ambulance, PO Leon allegedly slammed [redacted]'s keys into [redacted]'s hands (Allegation A: Discourtesy, [redacted]) and spoke discourteously toward him (Allegation B: Discourtesy, [redacted]).
On December 7, 2019, at approximately 3:30 p.m., [redacted] went to the 102nd Precinct stationhouse to obtain a copy of the police report regarding his dispute with the car dealership employee. There, he engaged in a verbal argument with PO Leon, who spoke discourteously to [redacted] (Allegation C: Discourtesy, [redacted]) and gave [redacted] the middle finger [redacted] (Allegation D: Discourtesy, [redacted]). An unidentified officer also spoke discourteously to [redacted] (Allegation E: Discourtesy, [redacted]).
The investigation determined that Sergeant Nicholas Guzman of the 102nd Precinct provided a false official statement to the CCRB (Allegation F: False Official Statement, [redacted]).
