Summary

On March 14, 2021, at approximately 10:24 PM, [redacted] was walking home to [redacted] in the Bronx, when he was approached by Sgt. Alejandra Perez, PO Ariel Perez, and PO Michael Kalendarev of the 41st Precinct. The officers arrested [redacted] due to an incident two weeks earlier, in which [redacted] had fled the scene of a traffic stop. While handcuffing [redacted] the officers repeatedly punched and kicked [redacted] (Allegations A, B, and C: Force, [redacted]). During this time, PO Perez said to [redacted] "I'm going to deck you out," and "I'm going to knee you in your fucking face" (Allegations D and E: Abuse of Authority, [redacted] Allegation F: Discourtesy, [redacted]). PO Perez and PO Kalendarev then allegedly dragged [redacted] from the entrance of his building to the sidewalk (Allegation G and H: Force, [redacted]). Lieutenant Jose Garcia, PO Sandor Burgos, and multiple other officers from the 41st Precinct arrived at the location. While officers were waiting on a police vehicle to transport [redacted] and a group of other individuals gathered around the officers. Lt. Garcia shouted at the crowd, "I'll get a fucking bus.
