On May 31, 2021, at approximately 4:06 p.m., [redacted] was standing near his car, which was parked in front of Nathan's Famous, located at 1310 Surf Avenue in Brooklyn, while his friends [redacted] and [redacted] 12-year-old daughter, [redacted] were getting food inside the restaurant. Police Officer Daniel Moussannef and Police Officer Richard Napolitano, both of the 60th Precinct, approached, and PO Moussannef allegedly threatened to tow [redacted] car (Allegation A: Abuse of Authority, [redacted]) and arrest him if he did not produce identification Allegation B: Abuse of Authority, [redacted]. PO Moussannef allegedly refused [redacted] request for a business card (Allegation C: Abuse of Authority, [redacted]), and took a photograph of [redacted] and [redacted] (Allegation D-E: Abuse of Authority, [redacted]).
