Summary

On December 15, 2022, at approximately 1:20 p.m., [redacted] went to the McDonalds on 2154 Nostrand Avenue in Brooklyn working delivery for UberEATS. [redacted] was sitting at a table, waiting for an order, when the security guard, [redacted] warned him that he could not sit there. [redacted] did not leave the table. Five minutes later, five police officers, including Jeffery Almanzar and Michael Lui (Field Training Unit 13), approached [redacted] and told him to leave. Although [redacted] initially refused to leave, he eventually complied and left the table. As [redacted] was leaving the McDonald's PO Almanzar pushed [redacted] (Allegation A: Force, [redacted]). [redacted] also alleged that PO Lui used force against him. (Allegation B: Force, [redacted]). Once outside, PO Almanzar told [redacted] to "get the fuck out" (Allegation C: Discourtesy, [redacted]) and allegedly said that he would "lock up" [redacted] if he went back inside the McDonalds (Allegation D: Abuse of Authority, [redacted]).
PO Almanzar and PO Lui then returned to their post and [redacted] called for an ambulance, complaining of shoulder pain. Shortly after the ambulance arrived, Sgt. Christopher Western (Field Training Unit 13) arrived on scene and spoke with [redacted] who said he wanted to file a complaint. Sgt. Western spoke with the officers and employees at the McDonald's. Sgt. Western then allegedly pushed [redacted] head into a metal door, twisted [redacted] arm, and arrested him for trespassing (Allegation E: Force, [redacted]). Read report for details.
