On January 14, 2023, at approximately 12:53 a.m., [redacted] was driving along Crotona Parkway and East 180th Street in the Bronx, with occupants [redacted] and [redacted]. Officers of the 44th Precinct stopped [redacted] vehicle (Allegation A: Abuse of Authority; [redacted] and PO Jorge Flores of the 44th Precinct threatened to arrest him (Allegation B: Abuse of Authority; [redacted] PO Flores physically removed [redacted] from the vehicle (Allegation C: Abuse of Authority; [redacted]). Once out of the vehicle, Lieutenant Michael Bowman, PO Flores, and PO Richard Castellano of the 44th Precinct punched him while on the ground (Allegations D-E: Force; [redacted]; Allegation F: Force; [redacted]); PO Castellano applied a chokehold to [redacted] (Allegation G: Force; [redacted]); PO Castellano continued to punch [redacted] while on the ground (Allegation H: Force; [redacted]); [redacted] stated that the officers being on top of him restricted his breathing (Allegation I: Force; [redacted]); Officers kicked [redacted] (Allegation J: Force; [redacted]).
