Ms. [redacted] states that on August 10, 1997 at about 11:30 p.m., she and her husband, Mr. [redacted] were returning from a party to their home at [redacted] As they walked to their [redacted] apartment, the two became involved in an argument. Mr. [redacted] suggested that they continue their argument inside of the apartment so as not to alarm their neighbors. Mr. [redacted] entered the apartment and Ms. [redacted] attempted to follow, holding her infant child in her arms. As she entered the doorway, Mr. [redacted] slammed the door shut on Ms. [redacted] hand, causing her to drop the baby headfirst onto the floor. Ms [redacted] went to a friend's apartment on the [redacted] floor to call an ambulance.
Later, three officers, identified by Ms. [redacted] as PO Kliffergon, PO Anderson and PO Guzman, placed Ms. [redacted] and her baby in the ambulance. Ms. [redacted] explained to the officers what had taken place with Mr. [redacted] She further stated that she did not want to press charges. However, the officers informed her that they were going to arrest Mr. [redacted] anyway. While in the ambulance with PO Kliffergon, her sister in law [redacted] baby, her [redacted] old son and her [redacted] -old daughter, Mr. [redacted] entered the ambulance and grabbed the baby. PO Kliffergon informed Mr. [redacted] that he was going to be placed under arrest. When Mr. [redacted] asked why, PO Kliffergon immediately began to push Mr. [redacted] and screamed at him to give up the baby. Mr. [redacted] asked if he have a few minutes with the baby before leaving. PO Kliffergon again pushed Mr. [redacted] causing him to fall onto Ms, [redacted] -old daughter. Six other officers entered through the back of the ambulance and began pushing Mr. [redacted] Mr. [redacted] released the baby to [redacted] Ms. [redacted] states that one of the officers handcuffed Mr. [redacted] who was then dragged out of the ambulance.
