Description: On October 30, 2012, at approximately 12:30 a.m., plaintiff, an avid photographer, was taking pictures of the effects of Hurricane Sandy near Madison Square Garden in Manhattan. He saw a police car with its lights on, so he attempted to wave to the officer to ask if he could continue walking on a certain street, but the officer ignored him. Plaintiff continued on his way, when he was suddenly confronted by another officer who accused him of failing to follow instructions. Plaintiff responded that he did not understand what the officer was talking about, and the officer then proceeded to search plaintiff.
