Plaintiff was returning from a party in Bedford Stuyvesant section of Brooklyn by subway with two friends. Shortly after exiting the rockaway avenue station of the C train, plaintiff and his friends happened to come across an acquaintance, Jevonte. Suddenly plaintiff and his friends and jevonte were stopped, questioned and frisked by several plainclothes officers from an unmarked car, including defendants Berardi, Franzel, and Sambolin. Plaintiff and two friends were not found to be in possession of contraband of any kind. Berardi noticed juvenile Jevonte holding midsection of his jacket as if he was secreting an object. Jevonte chose to run and was chased by Berardi. Plaintiff and his friends left the scene while Berardi was chasing Jevonte. Defendant Sambolin observed their departure and reported it to Berardi. Shortly thereafter Berardi observed Jevonte throw a firearm underneath a parked vehicle on Dean Street. Berardi apprehended Jevonte and recovered the firearm.Despite the fact that Jevonte's possession of a firearm had not been visible to plaintiff and his friends and that none of them possessed or were in constructive possession of the firearm, Berardi placed a radio call directing that they be arrested.

Defendant Officers approached Plaintiff after he pulled into his driveway and got out of his car, asked for his ID, became irate and assaulted Plaintiff. Plaintiff was taken to the 73rd Precinct and given a DAT, which was dismissed at arraignments.

On this occasion, defendant Sambolin created arrest paperwork in which he stated that the defendants had recovered a decorative sword, a machete, a gravity knife, and marijuana from the premises. DA declined to prosecute.

The Plaintiff was inside the premises of a commercial location when the defendant officers of the NYPD entered brandishing weapons - seized, handcuffed, and arrested plaintiff. The plaintiff was transported to a local precinct station house. The Defendant Franzel convinced the KCDA to prosecute the Plaintiff on multiple charges of gun possession and one count of criminally possessing gambling records. After the imprisonment of the Plaintiff, the charged were dismissed.
