Description: On July 19, 2012, plaintiff called the police regarding a break in at 177 Sheffield Avenue, Brooklyn, NY. (On July 10 and 12, 2012, individuals witnessed Kissia Diomande break into a second floor apartment of the building, managed by Ayoola Realty which is owned by plaintiff.) Officers, including Lerte and Hussain, told plaintiff a trespasser has 24 hours to leave the premises, and if Diomande had not left the premises by 6 P.M. on July 20, 2012, to call the police. On July 20, 2012, plaintiff called the police because Diomande had not vacated the apartment. Officers, including McGrath, arrived and told plaintiff he was overruling the officers from the previous day and Diomande would be allowed to stay. On July...
