Plaintiff was lawfully driving when he was illegally pulled over by Defendant who had no probable cause or reasonable suspicion to do so and Plaintiff exhibited no indicia or criminal or illegal behavior. Description: On or about February 2, 2023, Plaintiff Justin De La Cruz was involved in an incident at 305 80th Street, Brooklyn, NY, following a 911 call about a landlord-tenant dispute. The responding NYPD officers, including Daniel Wynne, Justin Garcia, Pedro Lopez, and Aaliyah Card, escalated the situation, even though no criminal matter was involved. Officer Wynne falsely broadcasted that Plaintiff was armed and involved in a murder, leading to the officers using excessive force.
