Description: On October 4, 2011, Plaintiff was approached by someone in a sweatshirt who he believed was an undercover officer. Plaintiff insulted him. NYPD Sergeant Anthony Famighetti, and P.O. Brian Christiansen, falsely arrested him. Subsequent to his release from the precinct, he exchanged words with the Detective, and he was then re-arrested without lawful basis. Plaintiff was grabbed and struck and suffered injuries. The Detective then made a false police report about Plaintiff.

Description: On February 2, 2012, Defendant police officers drove up to a Brooklyn street corner, where Plaintiff stood, eating a sandwich and conversing with friends, and ordered Plaintiff to place his hands on the window of a nearby liquor store. Plaintiff peacefully complied with the officers’ orders. Defendants then handcuffed Plaintiff, slammed Plaintiff’s head onto the hood of their police car, emptied Plaintiff’s pockets, and retrieved Plaintiff’s identification and $20 in cash, all without permission or authority. At no time during or subsequent to his arrest was Plaintiff read his Miranda rights.
