Description: On July 26, 2023, at approximately 6:30 p.m., Plaintiff was inside his residence located at 451 East 116th Street, County of New York, New York, when he heard a commotion outside. Mr. Rivas exited his apartment building to observe a car accident that had taken place between two vehicles. Mr. Rivas observed two police vehicles, multiple police officers and approximately twenty civilians surrounding the accident. Mr. Rivas, no longer interested in rubbernecking, was on his way back into his building when four Defendant officers followed him into the lobby of his building and forcefully pushed him, against the wall. Description: On February 19, 2013, plaintiff and her minor children were at her mother's apartment in East Harlem, NY. Plaintiff's sister Janece stopped by. Plaintiff and Janece argued over a family matter. Janece threatened plaintiff with a razor in the presence of several children. In response to a 911 call Janece made, officers from the 25th Precinct came to the apartment. When the officers arrived, Janece told them nothing serious happened. Janece conceded plaintiff had not assaulted her and denied suffering any injury. Officers arrested Janece and took her to the 25th Precinct, but concluded they lacked probable cause to arrest plaintiff.
