Description: On May 10, 2010, Plaintiff was walking with his family including adults and three children when they were attacked by a known gang. When officers arrived, rather than pursue the gang, Defendant Officer Dominick Desiervi threw Plaintiff to the ground, stomach down, knelt on his back, and cuffed him. Nothing was found in the resulting illegal search. Defendant Desiervi accused Plaintiff of being a gang member.
