Description: On October 3, 2019, plaintiff Berry was arrested by Detectice Yeuris Mejia ("Mejia") and other NYPD officers at the Pelham Bay Station of Defendant Metropolitan Transit Authority's IRT #6 line in anticipation of receiving his paycheck like he did for many of the previous pay periods. Immediately prior to his arrest, Berry noticed Transit employees Herer and John Doe #1-3 yelling profanities along with calling for officers to arrest Berry. Berry had no history of violence and Mejia, Larson, and Freyre were aware of Berry's ill health and sick leave when being arrested.
