Description: On August 25, 2016, Plaintiff and his friend Jesse were heading back after a night out at a local restaurant. Since Plaintiff had been drinking, Jesse drove them back. Upon their return to the neighborhood, Jesse told Plaintiff that he had to go upstairs to speak to his girlfriend. Plaintiff waited in the car in the passenger seat. Five minutes later, several officers including Officer Bergin approached the vehicle and asked Plaintiff what he was going, upon which Plaintiff said he was waiting for his friend to return. Description: On or about February 28, 2017, P.O. Marksberry, Bergin and other officers stopped the plaintiff Frances Menard when he was peacefully driving, and asked him to exit the motor vehicle. Then the defendants wrongfully detained, arrested, frisked, searched, assaulted, touched, battered the plaintiff Menard without justification, authorization, or cause. The plaintiff Menard was charged with operating a motor vehicle while under the influence of alcohol or drugs.
The defendants also arrested the plaintiff Rosa Devalle, who was seated in the passenger seat, for operating a motor vehicle while under the influence of alcohol or drugs.

Description: Defendant Officers approached plaintiff on the street corner. Defendant officers were going to issue a ticket to a double parked car when plaintiff asked for them to wait until he could get the driver out to move the vehicle. The Defendant officers then arrested the plaintiff. PO Bergen handcuffed plaintiff, and the officers drove him in a patrol car to the 45th precinct. He was charged by the officers with driving while intoxicated. The plaintiff was released later that day and acquitted of all charges.

Description: Defendant Officers approached Plaintiff in a subway station and questioned him about his bag and laptop. Officers searched his bag and his car (unclear when how search moved from station to car). Officers accused Plaintiff of having a fake driver's license, arrested him, took him to a station house, and used his phone to speak with Plaintiff's employer and family members. Plaintiff was strip searched and charged with making an illegal U-turn and driving with a suspended license. All charges were later dismissed.
