Description: On September 2, 2012, plaintiffs Luis Ortega, Alba Cuevas, Ana Gregorio, Evelyn Lugo, George Lugo, Edwin Avellanet, and Crystal Cruz were gathered at the home of Evelyn Lugo to celebrate Labor Day. Avellanet stepped outside to throw out a bag of garbage and was stopped and questioned by officers Charles Drobness and Ralph Conde, despite not committing a crime. The officers requested Avallenet's ID, and he refused after the officers refused to say why they needed it. The officers then grabbed him, and Avallenet pulled his arm away and escaped into the house.
