Description: On August 31, 2013, Plaintiff, an African-American male, was offered a ride by a Caucasian acquaintance, and accepted. Also present in the car was a second Caucasian man. The car was stopped by police officers. The three men were ordered out of the car at gunpoint. Plaintiff complied, and asked what was happening. Plaintiff was not engaged in any criminal conduct or in possession of any contraband. In response to Plaintiff’s question, one or more of the officers moved to strike Plaintiff and put him in handcuffs. During the incident, Plaintiff was also, inter alia, grabbed by, on information and belief, PO Serafin Resto, who proceeded to forcefully punch Plaintiff in the face so hard that the officer fractured ...

Complaint
Description: On May 17, 2011 at 1233 Trouy Avenue in Brooklyn, Plaintiff was on his friends' porch when a police van arrived and Detective Resto and other officers exited the van. Resto pointed his gun at plaintiff, threatened to kill him and handcuffed him. After the false arrest, plaintiff was in van for several hours and wasn't allowed to use the restroom. After the illegal strip search, nothing was found on plaintiff. On June 12, 2011 at 6pm inside a subway station at 5th avenue and 44th street in Manhattan, Sgt Christopher Chan and two other officers arrested plaintiff without reason. Chan, pointed his gun at plaintiff and ordered plaintiff to get on the ground.
