Description: On December 22, 2012, Plaintiff, a disabled veteran, was working in a food cart. Plaintiff occasionally video recorded officers who harassed the stand workers, including Defendant Officer James Moran. This led to confrontations between Defendant Officer Moran and Plaintiff. Plaintiff was filming Defendant Moran that day when Defendant Moran approached the cart, asked him to step out as he was going to be arrested pursuant to a warrant. Plaintiff shut off his phone and stepped out of the cart. Defendant Moran then slammed Plaintiff’s head against the cart, handcuffed him tightly and transported him to the precinct.
