Description: On February 27, 2016, the plaintiff, Wayne Scott, was a passenger in a van he had hired from Lowe's and was returning from a Lowe's store in Brooklyn with supplies for his friend's club. The van parked in the vicinity of Lexington Avenue and Classon Avenue, Brooklyn, and unloaded the supplies, and the driver went to a store to bring back change for the money that the plaintiff paid him, when the defendants approached the plaintiff and detained him. The plaintiff was questioned and searched without cause. The defendants found no weapon, controlled substances contraband, but arrested the plaintiff and put him in extremely tight handcuffs. Description: Defendant Officers were searching an apartment in Plaintiff's building and the tenant of the apt asked Plaintiff is she could secure it once they left. Plaintiff went to the apartment and was then told her son was arrested for assaulting an officer. Thereafter, Plaintiff was handcuffed and issued a summons for Disorderly Conduct and then released before being taken to a precinct. The charge was later dismissed.
