Description: On November 5, 2010, plaintiff was leaving a grocery store when he witnessed an assault while crossing the street. Plaintiff began to run and police arrived with guns and told him to stop. Officers Joan Ferrelar, Angel Lujan, and Bryant Zampella handcuffed plaintiff and placed him in a police car. He was brought to the precinct. He was assaulted by another inmate while sleeping and tried to defend himself but officers broke it up. Officers separated plaintiff from the other individual. Plaintiff then began to feel back pain and requested to go to the hospital. He fell asleep while awaiting EMS and woke up to the desk sergeant kicking his back.
