Description: Defendant Officer Cruz attempted to interrogate Plaintiff while he was recovering from surgery and heavily medicated after he was stabbed two days prior. Officer Cruz went to the hospital the next day and handcuffed/shackled Plaintiff to his hospital bed on charges of Assault in the 2nd and 3rd Degree, Menacing in the 2nd Degree, Harassment in the 2nd Degree, and Criminal Possession of a Weapon in the 4th Degree. Charges against Plaintiff were eventually dismissed.
