Description: On November 4, 2020, Plaintiff was near the intersection of 7th Ave and Leroy St in New York, NY. Defendants approached Plaintiff in an aggressive manner and tackled him to the ground. Defendants applied force to Plaintiff’s body, as he lay on the ground. Defendant Mulhern was among officers who struck Plaintiff, and failed to intervene in the actions of fellow officers. Description: Plaintiff helped his friend Desiree after her purse was stolen by an unknown man. Plaintiff was able to retrieve the purse for Desiree and they were walking away when a police vehicle stopped Desiree and later stopped Plaintiff and his friend and asked the Plaintiff if he had the unknown man's cell phone. Once Desiree came outside and handed Officer Vargas the phone, he told the Plaintiff that he "had to take somebody" and arrested him. Plaintiff was charged with Robbery in the Third Degree which was later dismissed.
