Description: On May 8th, 2013 Plaintiff was near an industrial area helping a friend unload a truck full of boxes to place into another van when Plaintiff and his friend observed a police car pass by, abruptly stop, and make a U-turn back to Plaintiff and his friend. When the owner of the property Plaintiff was moving saw police turn toward them he ran to a car and drove away. Det. Michael Michellena and other POs approached Plaintiff, asked regarding the owner of the property, and opened the boxes. POs discovered the boxes contained cartons of cigarettes. Plaintiff was arrested. Plaintiff explained he did not know where the owner went and that he was simply assisting in unloading unknown items but POs ignored him, placed h...
