Description: On May 23, 2012, at approximately 8:00 a.m., Plaintiff was lawfully laying in a hospital recovery room bed in Brookdale University Hospital in Brooklyn. Without probable cause or legal justification, several defendant NYPD officers unlawfully handcuffed Plaintiff, shackled him to his bed, and arrested him. One of the NYPD officers called Plaintiff’s mother and told her he had been arrested for stealing a cell phone on the subway, even though no such thing had occurred. Plaintiff’s mother went to speak with a judge about having the handcuffs removed; since there was no record of Plaintiff ever being arrested, the judge ordered the NYPD officers to immediately release him.
