Description: On February 20, 2012, Plaintiff was lawfully distributing his own original music on the sidewalk in Manhattan. Defendant Officers including Defendant Ramirez observed Plaintiff and without justification handcuffed and put Plaintiff in a Police vehicle. On February 29, 2012, Plaintiff was again lawfully distributing his own original music when Officer Kalkau and other unnamed Defendants, without legal justification, arrested Plaintiff on the sidewalk in Manhattan. On June 11, 2013, Plaintiff was arrested again by Defendant Officer Ramirez and several unnamed Defendant Officers.

Description: On April 17, 2012, Plaintiff was lawfully present on the street distributing CDs with his own music. He was approached by Defendant Officer Ramirez, who unlawfully searched Plaintiff. Plaintiff was then placed under arrest despite no probable cause. Defendants falsely informed the District Attorney they observed Plaintiff commit the following crimes: aggressive begging in a public place, disorderly conduct and resisting arrest. At no point did Plaintiff commit any crimes. Plaintiff was released and after being prosecuted, all charges were dismissed.
