Description: On October 11, 2013, Plaintiff was lawfully present on Church Avenue, Brooklyn, NY, with a small group of others, preparing to go out for his friend’s birthday. Numerous officers descended upon Plaintiff and the group. Officers radioed for “backup.” Pena arrested plaintiff for possessing marijuana, and was transported to the 67th Precinct. Plaintiff was searched but no contraband was found. Pena falsely informed the Brooklyn DA they found marijuana on Plaintiff’s person, and signed a Criminal Complaint which commenced a criminal proceeding against Plaintiff.
