Description: On July 9, 2017, plaintiff was arrested by Det. Joseph Franco, Det. Sean Haggerty, and Det. Sean Brown, as well as one undercover officer. The officers false reported that plaintiff participated in a drug sale and that they witnessed plaintiff drop narcotics on the ground. Plaintiff was arraigned the next day on the charges and held in jail until his court date. Plaintiff eventually took a plea agreement. Det. Joseph Franco committed perjury on multiple occasions, which led ADA Cyrus Vance to move to vacate the convictions that Franco was involved in, including Soto's.

NYPD officers assaulted and battered plaintiff after claiming he said he could get illegal drugs for people, which he denies saying. Plaintiff was wrongly incarcerated for 23 hours.

Description: On August 17, 2017, Plaintiff Herrera was approached at the Bowery Men’s Shelter Kenton Hall by undercover police officer UC00084 and asked about purchasing illicit illegal substances. Herrera, a homeless resident of the shelter, responded in the negative, knowing nothing about such transactions and exited the interaction. The next time he exited the shelter, Herrera was arrested by unknown police officers. A grand jury indicted him and he was arraigned for third degree criminal sale of a controlled substance and third degree criminal possession of a controlled substance. On March 29, 2018, Herrera was acquitted by jury due to false testimony and he was exonerated of any criminal liability.

Description: Defendant Officers pulled over a car where Plaintiff was the passenger for not signaling on a turn. Police searched the car, found a gravity knife, and arrested both driver and plaintiff for criminal poss of a weapon. Plaintiff was taken to the 121st Precinct, strip searched, then held at the hospital for 5 days and forced to ingest laxatives so that his excretion could be searched.
