Description: On October 26, 2014, an individual was assaulted by an unidentified person. After a month had passed, she participated in a line-up where she was shown hundreds of photos over a 3-4 hour time period, and she pointed out Plaintiff after being led by the defendant. There is no record on how she arrived at choosing the plaintiff. She stated that she wasn’t sure if Plaintiff was him but P.O.s still proceeded to ask suggestive questions as it pertains to Plaintiff. On May 2, 2015, Plaintiff was charged with assault in the third degree and other related charges, which were all dismissed 10 months later.
