Description: The plaintiffs were inside Times Square subway station when they were approached by the defendant. The defendant told Mr. Ellis that he was talking too loudly and prevented him from boarding the subway by pulling his arm. Plaintiff was then asked for identification and provided it, but was arrested. When the plaintiff asked for the cause of arrest, he was slammed against a metal gate and to the floor headfirst; plaintiff's head began to bleed as a result. Plaintiff was in and out the 58th (?) precinct and hospitals. Several hours later, both plaintiffs were arraigned and released. Mr. Ellis was charged with three counts of disorderly conduct.
