Description: On December 9, 2012, the plaintiff, Mr. Bazan, was riding in a livery cab driven by Jeffren Viera. Mr. Viera then stopped the cab and violently assaulted, battered, and robbed Mr. Bazan. After being stabbed in the hand with a knife and having his nose broken, Mr. Bazan escaped and ran to the nearby police precinct in Queens, New York. After finding Mr. Viera who had no injuries, and none of his property or money missing, the defendants arrested Mr. Bazan without probable cause. The individual defendants then spoke with the Queens County District Attorney's Office, lying that Mr. Bazan had violated New York Penal Law Section 110-160.15 and 165.15.
