Description: On December 17, 2018, Plaintiff Jane Doe, 40 weeks and 2 days pregnant (passed her due date), was arrested at her home by Defendant NYPD officers O'Rourke and Marciano for an incident related to a family dispute. There was no urgent need to arrest Plaintiff. Despite being visibly pregnant, Defendant officers transported her through multiple precincts without providing medical care, knowing she was in labor. At 9th Precinct she was taken by Defendant Detective Michael Franco to Manhattan Criminal Court. She was arraigned at Manhattan Criminal Court and released with no bail set.
