Description: On or about August 15, 2022, around 4:00 a.m., plainitff Jario Y. Espinal Ortiz was driving on the corner of East 198th Street and Webster Avenue, when he was pulled over by Police Officer Steven J. Marksberry for a traffic infraction. Plaintiff was asked to take a breathalyzer test, refused, and was arrested. All charges against Plaintiff were dismissed 10 months later on June 26, 2023. Plaintiff was falsely arrested and immediately had his license suspended and was unable to work for over a year. His suspension was eventually lifted on October 25, 2023.
