Description: On August 27, 2013, NYPD Officer Michael K. Fung and John Doe #1-8 (Defendants) entered Plaintiffs' home, where Deron Cooke also resided, purportedly executing a search warrant. Plaintiffs were detained for the duration of the search of their home. Defendants recovered a small quantity of marijuana from a dresser in Deron Cooke's room during their search of the residence. There was no contraband anywhere else inside the apartment. Afterward, Defendants arrested all four Plaintiffs as well as Deron Cooke. Plaintiffs were released from custody the same day after the King's County District Attorney's Office declined to prosecute Plaintiffs. Description: On March 14, 2012, plaintiff was in the vicinity of Boyland Street, Brooklyn, NY, meeting his father. Plaintiff was accosted by defendant officers with their guns drawn and ordered plaintiff to get on the ground. The defendant officers searched plaintiff and despite the fact they found nothing illegal they immediately placed plaintiff under arrest with his arms tightly behind his back and assaulted him. Plaintiff was transported to a nearby precinct and charged with Conspiracy, Possession of a Controlled Substance, Criminally Using Drug Paraphernalia, Unlawful Possession of Marijuana and Unlawful Possession of a Firearm.
