Complaint
Description: On June 3, 2018, Plaintiff was being attacked by a third party and four neighbors when officers approached. Officers began questioning Plaintiff about illegal activity even though no criminal activity was present or reasonably suspected. Officers then falsely accused Plaintiff of menacing, endangering the welfare of a child, attempted assault, and menacing and harassment. Officers performed an illegal search of Plaintiff's person, forcibly grabbed Plaintiff, and placed Plaintiff in tight handcuffs. Plaintiff was transported to the precinct and formally charged. All charges against Plaintiff were subsequently dismissed.

Description: On April 24, 2019, the plaintiff was unlawfully stopped, seized, searched, assaulted and arrested by the defendant PO including PO Zachary Benderwithout any reasonable suspicion of unlawful behaviour. The plaintiff who worked as a tow truck operator was called to the scene of an accident and when he arrived the defendants falsely accused the plaintiff of crimes including that the plaintiff's tow truck licences had expired and illegally searched the plaintiff. The plaintiff was then taken to the Precinct where the plaintiff was fingerprinted, photographed, strip-searched and detained for over 12 hours. The charges were dismissed on October 27, 2020.

Description: On June 20, 2019, defendant NYPD officer Zachary Bender, along with several unnamed NYPD officer defendants, unlawfully detained plaintiff Johnson and unlawfully arrested and detained plaintiff Alvarez. Defendant officers, including Bender, arrived at Johnson's apartment on such date, broke a window and entered the location without a search warrant or other legal reason. Johnson was not home, but Alvarez was. Defendant officers, including Bender, pointed their firearms at Alvarez while falsely accusing Alvarez of trespassing, then handcuffing her.
