Description: Plaintiff observed Defendant Officers ticketing his friend's car, asked if they "Don't have nothing better to do?" and was arrested by DO Barton and Arevalo, taken to the 78th Precinct, and charged with Vehicle and Traffic Law sections 1192(1) driving while ability impaired, 1192(2) driving while intoxicated; per se, and 1192(3), which were later dismissed and acquitted.
