Description: On August 12, 2012, approximately 5:00 p.m., at or near 46th Street and Sixth Avenue, defendant PO Nik Dedvukaj and others approached plaintiff without legal justification or excuse and searched plaintiff. The defendants had no probable cause or reasonable suspicion to believe that the plaintiff was engaged in an illegal activity. The search yielded no evidence of any guns, drugs or contraband. Despite the absence of any evidence of wrongdoing by the plaintiff, the defendants applied excessively tight handcuffs, formally arrested the plaintiff and transported him to a local precinct.
