Description: On or about August 1, 2023, Defendant NYPD officer Tong and other Defendant NYPD officers engaged a third-party (also a Defendant) in a vehicular chase. During the chase, initiated by the NYPD, the third-party lost control of their vehicle, drove up on a sidewalk, and struck the Plaintiff. The initiation of the pursuit was in violation of NYPD protocol and traffic laws. The commencement of the chase was negligent and reckless under the common law of NY State.
