Description: On March 5, 2011, NYPD’s Brooklyn South Vice Squad dispatched undercover officers to the bar and dance club that Plaintiff managed. NYPD officers had showed up on a near monthly basis for unannounced inspections for six years. One of the officers claimed he purchased several alcoholic beverages after 4 a.m., in violation of New York law. Plaintiff asserts this was a false allegation. Plaintiff was arrested by officer Billy Choi and charged with violating the Beverage Control laws. The criminal prosecution of Plaintiff continued for two and a half years. Plaintiff was found not guilty at trial. Plaintiff was forced to close his business because of the prosecution, and lost his livelihood.
