Complaint
Description: On August 18, 2019, Plaintiff Destiny Rivera was at the corner of Broadway and East 12th street when Defendant Detective Michael Simms and Defendant Officer Kevin Dwyer forcibly slammed Plaintiff of the ground. Defendants then handcuffed plaintiff and caused her to be confined and imprisoned in various locations. On that same day, Defendants submitted knowingly false statements against Plaintiff leading to initiation of prosecution against Plaintiff. On February 26, 2020, all criminal charges against Plaintiff were dismissed.
