Description: On April 24, 2023, while lawfully dressed in an Ironman costume and crossing West 44th Street and Broadway in New York, NY, alongside another Times Square performer dressed as Elmo, the plaintiff was neither conducting any business nor engaging with anyone—no conversations, no solicitation of money, no photographs. Despite this, the plaintiff was approached, stopped, searched, and arrested without any legal justification by defendants Mihai Tudor, Bryan Blachuciak, and John Doe.
