Description: On September 30, 2019, plaintiff was outside a grocery store located on Nostrand Avenue and Foster Avenue in Brooklyn when Defendant Officers entered the grocery store and arrested an individual in the store who was allegedly involved in a fight. Plaintiff began to record the arrest with their cell phone, but when Defendant Officers saw Plaintiff recording they yelled to stand back. Defendant Officers grabbed the phone out of Plaintiff's hand causing it to fall onto the ground, where the officers stopped others from picking it up. Description: On or about January 18, 2021, the plaintiff, Tameer Peak was lawfully attending a protest at City Hall Park, located at or near Chambers Street and Centre Street, in New York, NY, when he was forcibly seized and assaulted and battered by NYPD Police Officer James Morgante, without any legal justification, including, but not limited to being punched and kicked in the head.
