Complaint
Description: On July 7, 2023, Plaintiff was lawfully attending a memorial event at the rear of 765 Courtland Avenue in the Bronx when he observed police officers acting inappropriately with members of the community. Plaintiff began filming the officers' actions, at which point Defendant Officers Crystal Diaz and Michael DeLuna reacted by grabbing Plaintiff's phone, throwing him to the ground, and unlawfully seizing, searching, and falsely arresting him for Harassment, Menacing, Resisting Arrest, and Assault in the Second and Third Degree—despite Plaintiff committing no crime. As a result of the Defendants' actions, Plaintiff sustained serious injuries, including facial bruises and bumps on his head.
