Description: On May 3, 2018, Plaintiff was stopped by PO Michael Leone without probable cause or reasonable suspicion and began questioning Plaintiff. During the course of questioning, the officer asked Plaintiff what was in his pocket, and Plaintiff answered that he had a work knife there. Plaintiff produced the knife for the officer, who brought Plaintiff to a police precinct. Plaintiff was then arrested and charged with Criminal Possession of a Weapon in the Third Degree. In connection with the prosecution of Plaintiff, the officer signed a sworn accusatory instrument in which he made knowingly false claims. Plaintiff was incarcerated and required to appear in court. The criminal charge was dismissed on June 20, 2018.

Description: On or about August 23, 2016 at approximately 7:05 am, Plaintiff was in the vicinity of Union Square East and East 14th Street Subway Station in the County of New York, when Defendants two plain clothes Police Officers Manuel Sanchez and Officer Michael Leone unlawfully stopped, questioned and frisked Plaintiff without cause. Plaintiff was arrested, assaulted, battered and imprisoned for 2 days by the City of New York, New York City Police Department. Defendants made false and perjurious statements and submitted an erroneous police report and initiated a prosecution in bad faith. As a result of Defendants actions, Plaintiff suffered physical, psychological and emotional injuries.
