Complaint
Description: On February 13, 2019, the plaintiff was in a car as a passenger in the vicinity of Steuben Avenue and East 208th Street in the county of Bronx, when police officers including Officer Michelle Almanzar, approached the plaintiff and questioned the plaintiff regarding any illegal activity. The police officers then searched the plaintiff and arrested him in handcuffs. The plaintiff was taken to the 52nd Precinct where he was fingerprinted, photographed, strip-searched, and subjected to cavity inspection. The plaintiff was then transported to Central Booking where he was again strip-searched. After multiple court visits, the charges against the plaintiff were unconditionally dismissed on July 15, 2019.

Description: On October 17, 2019, Plaintiff Decedent Allen James and Raymond Rivera were travelling in an automobile in Bronx County near E. 211d Street and Bainbridge Avenue. Plaintiff Decedent was driving the vehicle and Raymond Rivera was the passenger. Defendant officer stopped the plaintiff's car and falsely alleged Plaintiff Decedent was not wearing seatbelts as a ruse to stop and search the vehicle. Defendant Sergeant Jonathan Rivera approached the vehicle and Plaintiff Decedent was ordered to exit said vehicle then ordered to re-enter.
