Description: Plaintiff was buying a cigar for smoking marijuana when he saw plain-clothed defendant officer approached him. Thinking that those might be robbers, plaintiff ran until he hit a van. Plaintiff was then told by a defendant officer who pointed a gun towards him to get out. After the plaintiff got out, he was assaulted by the defendant officers on the ground and was placed in a chokehold by defendant officer Foder. Plaintiff was assaulted again after he was in handcuffs. The assault resulted in injuries that plaintiff had to get a medical treatment. No charges or outcome is known.
